On the one hand, the <strong>draft Royal Decree on atmospheric protection and the update to the CAPCA<\/strong>, currently in the public consultation phase, introduces a comprehensive overhaul of the air emissions control regime. On the other hand, <strong>Royal Decree-Law 7\/2026 of March 20<\/strong> significantly brings forward the deadline for complying with the requirement to have <strong>sustainable commuting plans in place<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both initiatives reinforce a common approach: <strong>regulatory foresight, higher technical standards, and alignment with European objectives regarding public health, air quality, and reducing energy dependence<\/strong>.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-2\" id=\"h-un-nuevo-real-decreto-para-modernizar-la-proteccion-de-la-atmosfera\" style=\"color:#0f3780\"><strong>A new Royal Decree to modernize air quality protection<\/strong><\/h2>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-genesis-blocks-gb-columns gb-layout-columns-2 gb-2-col-equal\"><div class=\"gb-layout-column-wrap gb-block-layout-column-gap-2 gb-is-responsive-column\">\n<div class=\"wp-block-genesis-blocks-gb-column gb-block-layout-column\"><div class=\"gb-block-layout-column-inner\">\n<p class=\"wp-block-paragraph\">The draft Royal Decree on the protection of the atmosphere represents a <strong>comprehensive update to the regulatory framework established by Law 34\/2007<\/strong>, replacing and repealing regulations that, in some cases, had been in effect for decades. The stated objective is clear: <strong>to bring Spanish regulations in line with technical advances, the most recent European directives, and the current reality of industrial and energy activities<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the main focuses of the text is the <strong>comprehensive revision of the Catalog of Activities with the Potential to Pollute the Atmosphere (CAPCA)<\/strong>. The new catalog is designed to be a more accurate and consistent tool that is aligned with emissions inventories.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new version of the catalog includes new activities, adjusts power and capacity thresholds, corrects historical inconsistencies, and facilitates reclassification into groups (A, B, or C) based on actual pollution potential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the Royal Decree introduces, for the first time, a <strong>basic and systematic system of emission limit values (ELVs)<\/strong> applicable to activities that previously lacked clear guidelines or were subject to outdated regulations. In practice, the update to the CAPCA may entail <strong>changes in the administrative group and regime<\/strong> for certain facilities, which requires an advance technical review.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-4\" id=\"h-movilidad-sostenible-al-trabajo-el-plazo-se-reduce-de-dos-anos-a-uno\" style=\"color:#0f3780\"><strong>Sustainable commuting: the deadline is reduced from two years to one<\/strong><\/h2>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Royal Decree-Law 7\/2026<\/strong> introduces a change to <strong>Law 9\/2025 on Sustainable Mobility<\/strong> that will have a significant operational impact. Specifically, Article 63 reduces the maximum deadline for required workplaces to have a <strong>sustainable commuting plan in place<\/strong> <strong>from 24 to 12 months<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The requirement applies to workplaces with <strong>more than 200 employees<\/strong>, or <strong>more than 100 per shift<\/strong>, when that workplace is the employees\u2019 usual place of work. According to the preamble to the Royal Decree-Law itself, the measure responds to the need to <strong>immediately reduce energy costs associated with commuting<\/strong>, in a context of high price volatility and dependence on fossil fuels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This earlier deadline is forcing many organizations to rethink their internal schedules. The impact is greatest on those that had planned to implement these plans at later stages of the law\u2019s rollout.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, failure to comply with this requirement may have further consequences for companies receiving public aid under the Royal Decree-Law itself.<\/p>\n\n\n\n<div style=\"height:40px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-5\" id=\"h-un-mensaje-claro-para-empresas-e-instalaciones-afectadas\" style=\"color:#0f3780\"><strong>A clear message for affected businesses and facilities<\/strong><\/h2>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The common thread between the two regulations is clear: <strong>tighter deadlines and stricter technical requirements<\/strong>. Whether regarding air emissions or sustainable mobility, lawmakers are sending a clear signal that they are staying ahead of the curve and aligning with European goals of zero pollution and the energy transition.<\/p>\n\n\n\n<p
