{"id":35317,"date":"2026-04-22T11:30:11","date_gmt":"2026-04-22T09:30:11","guid":{"rendered":"https:\/\/www.pkf-attest.es\/noticias\/nuevo-plazo-para-tu-plan-de-movilidad-sostenible-2\/"},"modified":"2026-04-22T11:30:11","modified_gmt":"2026-04-22T09:30:11","slug":"nuevo-plazo-para-tu-plan-de-movilidad-sostenible-2","status":"publish","type":"noticias","link":"https:\/\/www.pkf-attest.es\/en\/noticias\/nuevo-plazo-para-tu-plan-de-movilidad-sostenible-2\/","title":{"rendered":"The deadline for your Sustainable Mobility Plan has been cut in half"},"content":{"rendered":"\n<h4 class=\"wp-block-heading has-text-color has-link-color wp-elements-1\" id=\"h-el-pasado-20-de-marzo-se-aprobo-el-real-decreto-ley-7-2026-bajo-el-titulo-plan-integral-de-respuesta-a-la-crisis-en-oriente-medio-se-trata-de-una-norma-de-urgencia-energetica-disenada-para-reducir-la-dependencia-de-los-combustibles-fosiles-y-acelerar-la-electrificacion-de-la-economia-ante-la-escalada-internacional-de-precios\" style=\"color:#099bbf\">On <strong>March 20<\/strong>, <strong>Royal Decree-Law 7\/2026<\/strong> was approved under the title <em>\u201cComprehensive Plan to Address the Crisis in the Middle East<\/em>.\u201d This is an <strong>emergency energy<\/strong> measure designed to reduce dependence on fossil fuels and accelerate the electrification of the economy in response to the global surge in prices.<\/h4>\n\n\n\n<h4 class=\"wp-block-heading has-text-color has-link-color wp-elements-2\" id=\"h-sin-embargo-entre-medidas-de-apoyo-al-transporte-a-la-industria-y-a-los-consumidores-el-decreto-incorpora-un-cambio-clave-para-las-empresas-que-ha-pasado-mas-desapercibido-la-reduccion-a-la-mitad-del-plazo-para-disponer-del-plan-de-movilidad-sostenible-al-trabajo-pmst\" style=\"color:#099bbf\">However, among the measures designed to support transportation, industry, and consumers, the decree includes a <strong>key change for businesses<\/strong> that has gone largely unnoticed: the <strong>halving of the deadline<\/strong> for implementing the <strong>Sustainable Commuting Plan (PMST)<\/strong>.<\/h4>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-3\" id=\"h-de-24-a-12-meses-la-nueva-fecha-limite-ya-esta-fijado\" style=\"color:#0f3780\"><strong>From 24 to 12 months: the new deadline has been set<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-4 wp-block-paragraph\" style=\"color:#000000\"><strong>Article 63 of Royal Decree-Law 7\/2026<\/strong> amends <strong>Law 9\/2025 on Sustainable Mobility,<\/strong> bringing forward by <strong>12 months<\/strong> the effective date of the requirement for affected companies to negotiate and develop Sustainable Mobility Plans (PMSTs).<\/p>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-5 wp-block-paragraph\" style=\"color:#000000\">In practice, this means that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-text-color has-link-color wp-elements-6\" style=\"color:#000000\">The duration of your Sustainable Mobility Plan has been cut in half. It has been reduced from <strong>24 to 12 months<\/strong>.<\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-7\" style=\"color:#000000\">The <strong>deadline is December 5, 2026<\/strong><\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-8\" style=\"color:#000000\">As of today, <strong>there are just 7 months left<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-color has-link-color wp-elements-9 wp-block-paragraph\" style=\"color:#000000\">A regulatory change that does not stem from a reform of the mobility law itself, but rather from an <strong>emergency energy decree<\/strong>, which explains why many organizations have not yet fully grasped its real impact.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-10\" id=\"h-el-pmst-no-es-un-documento-tecnico-para-cumplir-y-archivar\" style=\"color:#0f3780\"><strong>The PMST is not a technical document \u201cto be complied with and filed away\u201d<\/strong><\/h2>\n\n\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most common mistakes is to treat the <strong>Sustainable Mobility Plan<\/strong> as a technical document that is simply drafted, submitted, and filed away. <strong>Law 9\/2025<\/strong> is clear: the SMP is a <strong>negotiated process<\/strong> with labor, safety, and collective implications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Specifically, the regulation states that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-text-color has-link-color wp-elements-11\" style=\"color:#000000\">The plan must be <strong>formally negotiated with the workers&#8217; legal representatives (RLT)<\/strong><\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-12\" style=\"color:#000000\">If there is no works council, it is mandatory <strong>to establish a negotiating committee<\/strong> with the most representative unions in the sector<\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-13\" style=\"color:#000000\"><strong>Mobility will become a mandatory subject of collective bargaining<\/strong> for any bargaining committee formed on or after December 2025<\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-14\" style=\"color:#000000\">The PMST should <strong>be incorporated into the occupational risk assessment<\/strong> and addressed by the <strong>Occupational Safety and Health Committee<\/strong><\/li>\n\n\n\n<li class=\"has-text-color has-link-color wp-elements-15\" style=\"color:#000000\">A <strong>biennial follow-up report<\/strong> is required, with the active participation of the employee representative<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, we are not just talking about measures such as carpooling, cycling, or telecommuting. We are talking about <strong>governance, collective bargaining, and the traceability of the process<\/strong>.<\/p>\n\n\n\n<div style=\"height:60px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-16\" id=\"h-que-va-a-mirar-la-inspeccion-de-trabajo-y-que-no\" style=\"color:#0f3780\"><strong>What the Labor Inspectorate Will Look For (and What It Won&#8217;t)<\/strong><\/h2>\n\n\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-genesis-blocks-gb-columns gb-layout-columns-2 gb-2-col-equal\"><div class=\"gb-layout-column-wrap gb-block-layout-column-gap-2 gb-is-responsive-column\">\n<div class=\"wp-block-genesis-blocks-gb-column gb-block-layout-column\"><div class=\"gb-block-layout-column-inner\">\n<p class=\"wp-block-paragraph\">It is worth dispelling another myth.
