One area in which considerable progress has been made is <strong>security<\/strong>, for example, through <strong>biometric recognition systems<\/strong> that can accurately identify individuals, which can be used as a measure to restrict access to certain facilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">However, the use of such systems is considered <strong>high risk under <\/strong>the regulations, given the high <strong>sensitivity of biometric data<\/strong> as unique identifiers of individuals. This is accompanied by regulatory issues that must be observed in order to implement such systems, and failure to comply can lead to very heavy penalties.<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-2\" id=\"h-la-aepd-sanciona-con-10-000-000-a-aena-por-utilizar-un-sistema-de-reconocimiento-facial-para-la-gestion-del-embarque-de-pasajeros\" style=\"color:#0f3780;font-size:24px\">The AEPD fines AENA \u20ac10,000,000 for using a facial recognition system to manage passenger boarding<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">The <strong>AEPD has <\/strong> <strong>fined AENA \u20ac10 <\/strong>million for <strong>serious breaches <\/strong> <strong>of data protection regulations<\/strong> in the use of facial recognition systems, a form of processing that involves <strong>biometric data<\/strong>, which is considered a special category under the GDPR.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3\" id=\"h-deficiencias-y-tratamiento-de-datos\" style=\"color:#0f3780;font-size:20px\">Data deficiencies and processing<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">The Agency concludes that the <strong>Data Protection Impact Assessment (DPIA) carried out <\/strong>by AENA was deficient: it lacked signature and traceability, did not adequately describe the processing operations or their purposes, did not systematically analyze the necessity and proportionality of facial recognition, and did not correctly identify or assess the risks to users&#8217; rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">In addition, the AEPD emphasizes that AENA continued to process biometric data despite receiving unfavorable reports in previous consultations, without correcting the deficiencies identified. It also highlights that AENA did not justify why the biometric system was necessary in the face of less intrusive alternatives and that centralized storage increased privacy risks without sufficient safeguards.<\/p>\n\n\n\n<div style=\"height:10px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-4\" id=\"h-vulneracion-del-rgpd-y-consecuencias\" style=\"color:#0f3780;font-size:20px\">Violation of the GDPR and consequences<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">For these reasons, the AEPD considers that <strong>Article 35 of the GDPR ( <\/strong>obligation to carry out a valid DPIA before processing high-risk data) has been violated and imposes the sanction, together with the temporary suspension of biometric processing until AENA submits a DPIA in accordance with the regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">AENA has announced that it will appeal the decision, considering that the sanction does not respect the principle of proportionality.<\/p>\n","protected":false},"featured_media":21282,"template":"novedad-corporativa-single-post.php","categories":[],"tags":[214,212],"novedades_corporativa":[],"class_list":["post-35327","noticias","type-noticias","status-publish","has-post-thumbnail","tag-gdpr","tag-news","entry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v28.5 (Yoast SEO v28.5) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Is biometric recognition legal?
