Its recent guide concludes that these systems, considered biometric data processing, present <strong>high risks for the rights of workers<\/strong> and that their legal legitimacy is very limited.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-2\" id=\"h-la-aepd-limita-el-uso-de-biometria-en-el-trabajo\" style=\"color:#0f3780;font-size:24px\">AEPD limits the use of biometrics in the workplace<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">The General Data Protection Regulation (GDPR) establishes that biometric data is a special category of personal data. The AEPD reminds that their processing <strong>cannot be based on the employee&#8217;s consent<\/strong>, as there is a clear imbalance in the employment relationship. In addition, it insists that <strong>less intrusive alternative measures<\/strong> (such as cards or digital clocking systems) should always be prioritized.<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-3\" id=\"h-alternativas-y-medidas-de-seguridad-recomendadas\" style=\"color:#0f3780;font-size:24px\">Alternatives and recommended security measures<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:16px\">Although exceptions are considered, the AEPD stresses that only exceptionally and under a strict analysis of necessity and proportionality could the use of biometrics be justified.
