On June 25, 2019/1021 Regulation (EU) 2019/1021 of the European Parliament and of the Council of 20 June on persistent organic pollutants was published in the Official Journal of the European Union.
The purpose of this regulation is to protect human health and the environment against POPs by prohibiting, phasing out or restricting the manufacture, marketing and use of substances subject to the Stockholm Convention on Persistent Organic Pollutants or the Protocol on Persistent Organic Pollutants to the 1979 Convention on Long-Range Transboundary Air Pollution, by reducing the emission of such substances, with a view to eliminating them, and by establishing provisions for wastes consisting of, containing or contaminated by any such substances.
In order to ensure the implementation of the European Union's obligations under the Protocol and the Convention, a common legal framework has been established to eliminate the manufacture, marketing and use of internationally manufactured POPs.
The Regulations establish the following aspects:
- Some definitions are specified and terminology is adapted.
- Regulates the control of the manufacture, commercialization and use of substances.
- Rules are established on the management of obsolete and stockpiled POPs.
Stocks of banned substances should be treated as waste, while stocks of substances whose manufacture or use is still permitted should be reported to the authorities and adequately monitored.
- Releases of POPs that are unintentionally generated from industrial processes should be reduced as soon as possible with the objective of eliminating them as far as possible.
Regulation (EC) No. 850/2004 of the European Parliament and of the Council of 29 April 2004 on persistent organic pollutants and amending Directive 79/117/EC is hereby repealed.
